ORDINANCE No. 03-06

 

            AN ORDINANCE AMENDING CHAPTER 30 SIGNS, OF THE TOWN OF FORT MYERS BEACH LAND DEVELOPMENT CODE; PROVIDING AUTHORITY; AMENDING SEC. 30-2 DEFINITIONS AND RULES OF CONSTRUCTION, SEC. 30-4 PROHIBITED SIGNS, SEC. 30-5 PERMITTED SIGNS, SEC. 30-51 VIOLATION OF CHAPTER, PENALTY, SEC. 30-53 POWERS AND DUTIES OF BUILDING OFFICIAL, SEC. 30-55 PERMITS, INSPECTIONS, SEC. 30-56 NON-CONFORMING SIGNS, SEC. 30-93 LOCATION, SEC. 30-94 CONSTRUCTION STANDARDS, LANDSCAPING, SEC. 30-95 SIGN IDENTIFICATION AND MARKING, SEC. 30-152 PERMANENT SIGNS IN RESIDENTIAL AREAS, SEC. 30-153 PERMANENT SIGNS IN COMMERCIAL AREAS; PROVIDING SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.

 

IT IS HEREBY ORDAINED BY THE TOWN OF FORT MYERS BEACH AS FOLLOWS:

 

SECTION 1.  AUTHORITY.  This Ordinance is enacted pursuant to the provisions of Chapter 95-494, Laws of Florida, Chapters 163 and 166, Florida Statutes, and other applicable provisions of law.

 

SECTION 2. AMENDING CHAPTER 30 SIGNS, OF THE LAND DEVELOMENT CODE.  The amendments to Chapter 30 are contained in the attached Exhibit A.  Entirely new language is indicated with underlining and language being repealed from the regulations is indicated with strike-throughs.  The Amendments are found in Sec. 30-2 Definitions and rules of construction. 30-4 Prohibited signs. 30-5 Permitted signs. 30-51 Violation of chapter; penalty. 30-53 powers and duties of building official. 30-55 permits; inspections. 30-56 non-conforming signs. 30-93 location. 30-94 construction standards; landscaping. 30-95 sign identification and marking. 30-152 permanent signs in residential areas. 30-153 permanent signs in commercial areas.

 

SECTION 3. SEVERABILITY.  If any one of the provisions of this ordinance should be held contrary to any express provision of law or contrary to the policy of express law, although not expressly prohibited, or against public policy, or shall for any reason whatsoever be held invalid, then such provision shall be null and void and shall be deemed separate from the remaining provisions of this ordinance, and in no way affect the validity of all other provisions of this ordinance.

 

SECTION 4.  EFFECTIVE DATE.  This ordinance shall take effect immediately upon its adoption.

 

            The foregoing ordinance was enacted by the Town Council upon a motion by Council Member Rynearson and seconded by Council Member Van Duzer and, upon being put to a vote, the result was as follows:
