7. Public Hearing: Antonio and Sharon Rigby (Rigby’s Health Shoppe, 1188 & 1190 Estero) 97-07-226.05V. A Variance request in the c-1 district from the parking space requirement of one parking space per 200 square feet of total floor area for a health center requiring 6 parking spaces per LDC 34-2020 (2)m.2., to allow 4 existing parking spaces.
8. Public Hearing: Jane B. Plummer -(310 Madison Ct.)97-08-046.05V. A variance request in the RS-1 district from the side setback requirement of 15 feet for corner lots that were recorded prior to January 28, 1983, having a lot width less than 100 feet and abut two local streets, per LDC Section 34-2192 (2)b.1, to allow a side setback of 2 feet from Shell Mound Ave. A variance request in the RS-1 district from the required waterbody setback for a non-roofed structure of 5 feet from a seawalled canal, per LDC Section 34-2194©(3)b.1, to allow zero ( 0 ) foot setback. A variance request in the RS-1 district from the fence height requirement in a residential area located between a street right-of-way or easement and the minimum required street setback line to not exceed 3 feet in height, per LDC section 34-1744(b)(1), to allow 6 feet in height along Shell Mound Avenue.
9. Public Hearing -Daniel Reinfried (Gullwing, 6620 Estero) 97-08-063.05V. A variance request in the CT(tourist commercial) district from the height limitations for Estero Island as set forth in the LDC section 34-2175(3) which limits the height of a structure to 35 ft. above grade except as provided in Section 34-2174 (application is pre-repeal of 34- 2174), to allow a building 104 feet in height. A variance request in the CT district from the provisions of LDC section 34-1802 which permits additional height when setbacks are increased to allow the side setbacks to be decreased from the required 54.5 feet for a 104 foot high building, to allow a side setback of 35 feet from the north and south property lines. A variance request in the CT district from the number of efficiency rental units permitted (32 units) per LDC section 34-1802(4), to allow 66 rental units. A variance request in the CT district from the required maximum floor area per unit for efficiency rental units of 550 square feet per LDC section 34-1802(6) to allow a maximum unit size of up to 1,975 square feet.

10. Public Hearing: Ordinance amending the ordinance establishing the Marine
Resources Task Force - This ordinance reflects changes requested by the Council as to number of members and terms.
11. Resolution setting standardized towing rules and regulations – The resolution was directed by the Council to be placed on the agenda in order to provide that a credit card may be used by the person towed in a non-consent private property tow.
12. Discussion of Referendum questions – This item allows the public to ask questions of the Council with regard to referendum questions or to offer comment.
